01Overview
Understanding professional tax and its applicability in India
Professional Tax (PT) is a state-level tax levied on eligible individuals earning income through employment, professions, trades, or other specified activities. It is applicable only in states and jurisdictions where professional tax is imposed under the relevant legislation.
Requirements vary from state to state. Employers may be required to deduct professional tax from employees' salaries and deposit it with the concerned state authority. Self-employed professionals, business owners, and other eligible individuals may need to pay the applicable tax directly.
Businesses operating in applicable states must understand their obligations, complete the required registration or enrolment, and comply with payment and return-filing requirements. Failure to meet these obligations may result in penalties or other legal consequences.
02Who Is Liable
Who is liable to pay professional tax?
Depending on the applicable state law, professional tax may apply to:
Salaried employees
Individuals whose salaries fall within the applicable professional tax criteria.
Employers and businesses
Employers responsible for deducting and depositing professional tax from employees' salaries, where required.
Self-employed professionals
Eligible doctors, lawyers, chartered accountants, consultants, and other professionals.
Business owners and traders
Individuals carrying on eligible trades, businesses, or commercial activities.
Companies, firms and other entities
Businesses with registration, enrolment, or payment obligations under the relevant state legislation.
03Calculation
How is professional tax calculated?
Professional tax is generally calculated according to income slabs and other criteria prescribed by the relevant state government. The applicable rates, exemptions, payment schedules, and filing requirements differ across states.
Under Article 276 of the Constitution of India, the maximum professional tax payable by an individual to a state or local authority is capped at ₹2,500 per year. The actual amount payable depends on the applicable state rules and the taxpayer's category.
04PTEC and PTRC
What are PTEC and PTRC?
In states that use these registration categories, professional tax compliance may involve the following certificates. The terminology, eligibility criteria, and registration requirements may vary by state.
PTEC (Enrolment Certificate)
Generally applies to eligible professionals, business owners, or entities liable to pay professional tax on their own behalf.
PTRC (Registration Certificate)
Generally applies to employers required to deduct professional tax from employees' salaries and deposit it with the relevant authority.
05Uttar Pradesh
Is professional tax registration applicable in Uttar Pradesh?
Professional tax is not levied in Uttar Pradesh under the current applicable framework. Therefore, businesses and professionals operating exclusively in Uttar Pradesh generally do not need Professional Tax Registration for the state.
However, businesses with employees or operations in other states should check the professional tax laws applicable in those locations. Registration and payment obligations depend on the relevant state legislation and the nature of the business or employment relationship.
